JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 09-05-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections-302, 328/34 of the Indian Penal Code. The informant expressed his suspicion against petitioner and co-accused Ajay Rai and stated that both the abovesaid persons had administered poisonous liquor to his father as a result whereof, his father died.

In course of hearing, learned counsel for the petitioner produced the order dated 04-04-2015 passed in Sessions Trial No. 129 of 2015 by the learned Additional Sessions Judge-II, Rohtas at Sasaram by which, the aforesaid court had rejected the prayer for bail of the petitioner.

No.20200 of 2016 (2) dt.09-05-2016 2/2 It would appear that except suspicion, there appears to be nothing against the petitioner and moreover, co-accused, Ajay Rai, having more or less similar allegation, has already been granted privilege of bail by a coordinate bench of this court. Accordingly, the petitioner named above, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Chenari P.S. Case No. 80 of 2012 corresponding to Sessions Trial No. 129 of 2015 to the satisfaction of learned Additional Sessions Judge-II, Rohtas at Sasaram. (Hemant Kumar Srivastava, J) A.K.V./- U T
