2. Petitioner seeks regular bail in a case registered for the offences punishable under Sections 147, 148 , 149 and 302 of the Indian Penal Code and section 27 of Arms Act. 3 . As per the prosecution case , informant namely , Anil Kumar alleged that on 20.09.2023 , all the F.I.R. named accused persons including this petitioner came at the field of informant and started measuring his land. Upon objection by brother of informant, this petitioner and other co-accused persons fired upon him, as a result of which, brother of informant sustained firearm injuries and later, upon reaching the hospital, doctor declared him dead.

4. Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence as alleged. Only suspicion has been raised against this petitioner. During course of investigation , police submitted final form against coaccused Upendra Kumar and Awadesh Kumar who was named in the F.I.R. Petitioner is in custody since 06.03.2025 . 5 . However, learned A.P.P. for the State vehemently opposed the bail application and submitted that there is direct and specific allegation that this petitioner along with other coaccused persons caused firearm injury to the brother of informant due to which he died. Police after thorough investigation submitted chargesheet against this petitioner and others.

6. Considering the nature of accusation, prayer for bail of the petitioner is refused. However, since petitioner is in custody since 06.03.2025 , learned Trial Court is directed to expedite and conclude the trial, within the period of one year from the date of receipt/production of copy of this order.
