Heard learned counsel for the petitioner and learned counsel for the State.
Petitioner apprehends his arrest in connection with Bhimpur P.S. Case No. 53 of 2016 registered under Sections147, 149, 341, 323, 325, 307 and 504 of the Indian Penal Code. The allegation against the petitioner is that he alongwith other accused persons attempted to kill the son of the informant.
Learned counsel for the petitioner submits that there is case and counter case between the parties and in the alleged occurrence both sides have sustained injuries. It is
Patna High Court Cr.Misc. No.1380 of 2017 (2) dt.16-01-2017 2/2 further submitted that injury report does not support the allegations. It is further submitted that similarly situated coaccused has been granted bail by this Court vide order dated 16.12.2016 passed in Cr. Misc. No. 48668 of 2016. Considering the facts and circumstances of the case specially the fact that co-accused has been granted bail by this Court, the petitioner, above named, in the event of arrest or surrender within a period of four weeks from today, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri Sunil Kumar, Judicial Magistrate, Supaul in connection with Bhimpur P.S. Case No. 53 of 2016 subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure.
