JUSTICE ARUN KUMAR JHA ORAL ORDER 02-12-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State through video conferencing. In the present case, the petitioner seeks bail in connection with Nautan P.S. Case No. 360 of 2022 registered for the alleged offences under Section 414 of the Indian Penal code and Section 30 (a) of the Bihar Prohibition and Excise Act. As per prosecution case, the police received a tip off about the illicit liquor being transported in a car and a person was doing work of liner who was driving ahead the said car on a motorcycle. The checking of the vehicles started and the two motorcycles and the car were intercepted. From the car, this petitioner was apprehended. From the car and motorcycles, total 224.64 liters of India made foreign liquor was recovered.

Nothing incriminating has been recovered from the conscious possession of this petitioner. Neither the seized motorcycles nor the Santro car belong to this petitioner and he has no concern with the alleged occurrence. The petitioner is in custody since 30.06.2022. The charge sheet has been submitted in this case.

Learned APP opposes the prayer for bail.

Having regard to facts and circumstances and submissions made here-in-above and considering the period of custody of the petitioner and the submission of charge sheet, he is directed to be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Judge, Excise, Bettiah, West Champaran, in connection with Nautan P.S. Case No. 360 of 2022, subject to the conditions mentioned in Section 437 (3) of the Code of Criminal Procedure and also the following conditions :

(i) One of the bailors will be a close relative of the petitioner.

(ii) The petitioner will remain present on each

(iii) In case of absence on three consecutive dates or in violation of the terms of the bail, the bail bond of the petitioner will be liable to be cancelled by the court concerned.
