The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 448, 341, 323, 354, 506/34 of the Indian Penal Code and 3 (iii) (x) (xi) (xii) of SC/ST (Prevention of Atrocities) Act. It is alleged that the petitioner entered into the house of the informant and he tried to outrage the modesty of the informant and assaulted the informant.

It is submitted by learned counsel for the petitioner that the petitioner lodged Asarganj P.S. Case No. 88 of 2014 against the informant at earlier point of time and as a retaliatory measure the present case has been lodged. It is further

Patna High Court Cr.Misc. No.2359 of 2015 (02) dt.20-01-2015 2/2 submitted that the occurrence took place inside the house of the informant, hence, it cannot be treated to be a place of public view.

A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent. Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Munger in connection with Asarganj P.S. Case No. 89 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
