The following reliefs have been sought for by the petitioners in the present writ application.

"1(i) The respondents may be directed to complete the selection process of teachers who have passed eligibility in 2011 (Secondary/Senior Secondary Teachers Eligibility Test 2011 and Elementary Teacher Eligibility Test 2011) against the vacancy notified in the newspaper numbering 106089 (Secondary/HigherSecondary/Element -ary Teachers) and total 53000 candidates had applied for the said

Patna High Court CWJC No.22567 of 2013 (5) dt.13-11-2017 2/2 post in Secondary/Higher Secondary and Elementary Schools and then only to appoint trained teachers in the elementary schools.

(ii) The respondents may be directed to treat these posts vacant unless it is fulfilled and do not transfer the post saying to be a back-log.

(iii) The joining the post in Elementary Schools resigning from that post and again joining in Higher and Higher Secondary will not be treated to be back-log.

(iv) The respondents may be directed to declare 53000 candidates as against vacancy of 106089 and only eligible candidates and therefore question of back-log does not arise."

Considering the reliefs sought for by the petitioners in the present writ application, the petitioners are directed to approach the competent authority who shall consider the claim of the petitioners in accordance with law and take necessary steps in respect to redressal of grievance of the petitioners. With the aforesaid observations and directions, the present writ application stands disposed of.
