2. Petitioners seeks bail in a case registered for the offence punishable under Sections 307,498A,304B/34 and other ancillary sections of the Indian Penal Code and sections 3 & 4 of the Dowry Prohibition Act.

3 . It is a case of dowry death . It is alleged that the marriage of daughter of informant was solemnized with this petitioner in the year 2021 . And after sometime of marriage ,

No.60965 of 2024(3) dt.25-10-2024 2/3 this petitioner along with other co-accused persons named in the FIR tortured and harassed the victim for non-fulfillment of demand of dowry and finally committed murder of daughter of informant by setting her on fire after pouring kerosene oil on her.

4. Learned counsel appearing for the petitioner submits that petitioner has falsely been implicated in this case because he happens to be husband of the victim. Petitioner has not committed any offence as alleged. As a matter of fact, during course of cooking, deceased herself caught fire and got burn injury and thereafter she was taken to hospital and during course of treatment she died. Petitioner is in custody since 13.03.2024 .

Learned counsel for the State opposes the bail petition and submits that petitioner is husband of the deceased and there is specific allegation that he along with other coaccused persons committed torture for dowry and later on killed the victim by setting her on fire . Deceased died within seven years of marriage at her matrimonial house in an unnatural circumstances.

6. Considering the nature of accusation and the fact that petitioner is husband of the deceased and deceased died at
