The matter relates to the compassionate appointment of daughter's son (Nati) as having been claimed that his Nana had died in 2002 leaving behind his three daughters and petitioner is son of second daughter, namely, Biraj Devi.

As per the statement of the petitioner in this writ application, he had applied for the first time within two years when the application became traceless he again filed application for compassionate appointment and it is pending. No decision has been taken in this application.

Patna High Court CWJC No.25594 of 2013 (2) dt.20-12-2017 2/2 This Court does not know about status of the family of the petitioner vis-a vis his father and the brother. Compassionate appointment is not a source of appointment but mere giving benefit to the family to tied over financial crisis. In that view of the matter, concerned authority is directed to consider the case of the petitioner and take decision in accordance with law. While taking decision the respondent will examine whether the Nati comes under the purview of compassionate appointment scheme. The respondent will also consider the status of the family with respect to the employment vis-a- vis property. At the same time, he will also consider whether long lapse of time still the family is in financial distress. The respondent will take decision within a period of four months from the date of receipt/production of a copy of this order. With this aforesaid observation and direction this writ application is disposed of.
