The petitioner seeks regular bail in connection with Raghunathpur PS case no. 213 of 2017 registered for the offence punishable under Sections 272, 273, 308 of Indian Penal Code and 30, 38, 41 of Bihar Prohibition and Excise Act, 2016. The allegation is regarding recovery of 120.96 ltrs. of illicit liquor from a Scorpio vehicle and the petitioner had tried to escape from the Scorpio vehicle but was apprehended by the police. The petitioner is stated to have been arrested subsequently.
The learned counsel for the petitioner submits that the petitioner is innocent and on account of his earlier criminal antecedents, he has been falsely roped in the present case. It is
Patna High Court Cr.Misc. No.47713 of 2018(3) dt.14-12-2018 2/2 further submitted that the petitioner has earlier moved this Court for grant of regular bail but his prayer was rejected vide order dated 19.04.2018 passed in Cr. Misc. no. 20051 of 2018, however liberty was granted to renew the prayer for bail after completion of six months, hence the petitioner has again moved this Court for grant of regular bail after expiry of more than six months. Lastly, it is submitted that in all the five cases which are pending against the petitioner herein, he has already been granted bail.
Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner on regular bail.
Accordingly, the abovenamed petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of Addl. District & Sessions Judge- 2nd, Siwan in connection with Raghunathpur PS case no. 213 of 2017. (Mohit Kumar Shah, J) rinkee/- U T
