2. The petitioner has preferred this application for grant of regular bail in connection with Saraiya P.S. Case No. 267 of 2023 dated 07.05.2023 registered for the offences punishable under Section 392 of the Indian Penal Code.

3. As per the prosecution case, three unknown miscreants are alleged to have looted Rs. 500/-, mobile and motorcycle of the informant.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. The petitioner is not named in the FIR. No T.I.P has been conducted by the prosecution. Nothing has been recovered

Patna High Court CR. MISC. No.63451 of 2024(2) dt.01-10-2024 2/2 from the possession of the petitioner. The petitioner has no concern with the alleged offence. The petitioner has four criminal antecedents as stated in para 3 of the bail petition. The petitioner is in custody since 16.05.2024.

5. Learned A.P.P. for the State has opposed the bail petition of the petitioner and submitted that the looted motorcycle has been recovered from the house of the coaccused, Md. Salman.

6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Muzaffarpur in connection with Saraiya P.S. Case No. 267 of 2023.

7. The application stands allowed.
