The petitioner seeks bail in a case registered under Sections 399, 402, 414 of the Indian Penal Code and Sections 25(1-b)a, 26, 35 of the Arms Act.

Allegation is that one loaded country made pistol along with five cartridges are recovered.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 9.5.2019 and has got no criminal antecedent. Charge sheet has been submitted in the case. There is no allegation of tampering of witnesses alleged against the petitioner. No arms is alleged to have been recovered from the possession of the petitioner. One loaded country made pistol along with five cartridges are said to have been recovered

Patna High Court CR. MISC. No.52933 of 2019(2) dt.23-08-2019 2/2 from co-accused Suraj Kumar and Md. Shahid. Other coaccused has been granted bail vide Cr.Misc.No.44970 of 2019. On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sri Manoj Kumar, J.M. 1st class, Barh, Patna in connection with Mokama P.S. case No.89 of 2019.
