Petitioner, who is in custody, seeks bail in connection with Bettiah Muffasil P.S. Case No. 67 of 2018 registered for the offences punishable under Sections 302/34 of the Indian Penal Code.
Allegation against the petitioner and other accused persons is of killing of daughter of informant and tried to obliterate evidence.
It has been submitted on behalf of the petitioner that petitioner is innocent and has been falsely implicated in this case on the basis of suspicion. It has been further submitted that deceased had consumed poison and on information petitioner rushed to his house and took her to M.J.K. hospital Bettiah and
Patna High Court Cr.Misc. No.45634 of 2018(4) dt.05-11-2018 2/2 from there she was referred to Motihari Hospital but she died in the way to hospital and thereafter petitioner came with dead body but was arrested by police and dead body was sent to postmortem. During investigation neighbourhood witnesses have stated that there was some altercation between husband and wife and thereafter petitioner went Bus stand to attend his duty while deceased consumed poison and on information to petitioner he rushed to his home and carried deceased to hospital but she could not be saved. Petitioner has no criminal antecedent. Petitioner is in custody since 16.02.2018. Considering the aforesaid fact and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, West Champaran, Bettiah, in connection with Bettiah Muffasil P.S.
