JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 16-11-2019 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Ekma P.S. Case No. 259 of 2018 corresponding to Sessions Trial No. 392 of 2019, registered for the offences punishable under Sections 498(A), 302, 304(B) and 34 of the Indian Penal Code.

Petitioner is husband of the deceased. There is allegation of demand of dowry and due to non-fulfillment of demand of dowry, the informant's daughter was done to death. It is submitted by learned counsel appearing on behalf of petitioner that petitioner is innocent. Charge-sheet has already been submitted. Petitioner is in custody since 24.10.2018 having clean antecedent.

Patna High Court CR. MISC. No.53992 of 2019(4) dt.16-11-2019 2/2 In view of the fact that petitioner is husband of the deceased, I am not inclined to enlarge the petitioner on bail. Accordingly, the same is rejected.

However, the trial court is directed to conclude the trial within one year from today. If the trial is not concluded within the stipulated period, the petitioner will be at liberty to renew his prayer for bail.
