JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 03-04-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Chenari P.S. Case No. 22 of 2015 registered for the offences punishable under Section 307 and other minor sections of the Indian Penal Code.

The allegation against the petitioner is that he participated in the communal clash and he is very much named in the first information report.

Therefore, I am not inclined to grant the privilege of anticipatory bail to the petitioner and accordingly, his prayer for anticipatory bail in connection with Chenari P.S. Case No. 22 of 2015 pending in the court of Sri A.P. Chaudhary, Judicial

Patna High Court Cr.Misc. No.12472 of 2015 (2) dt.03-04-2015 Magistrate 1st Class, Rohtas at Sasaram/concerned court stands rejected.

However, it is made clear that if petitioner surrenders before the concerned court within four weeks from today and seeks regular bail, the concerned court shall consider the regular bail application of the petitioner on its own merit without being prejudiced by this rejection order, particularly, keeping in mind that some co-accused have already been granted privilege of regular bail by the learned Sessions Judge, Rohtas.
