Heard learned counsel for the petitioner and the learned A.P.P. for the State as also the learned counsel for the informant. The petitioner apprehends his arrest in connection with Singhiya P.S. Case No.43 of 2016 registered under Sections 147, 148, 149, 379, 341, 323, 324, 307 and 427 of the Indian Penal Code besides Section 27 of the Arms Act.

The accusation is that five persons, named in the F.I.R. including the petitioner and 10 unknown variously armed started to commit loot of maize crops of the informant. When the informant made protest, this petitioner gave farsa blow causing

Thereafter, all the accused started to open firing indiscriminately through country made pistol. In that course, the firing of Siddheshwar Singh hit Munnu Kumar Jha, the son of the informant, who became unconscious.

Learned counsel appearing on behalf of the petitioner submits that the petitioner is the student of the Institute of Business Management, affiliated to the L.N.M.U. Darbhanga, and he has falsely been implicated in this case with an ulterior motive. Moreover, the injury, as said to be caused to the informant by this petitioner through Farsa, is simple in nature Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender by him within six weeks from today, be enlarged on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Rosera, District-Samastipur, in connection with Singhiya P.S. Case No.43 of 2016, subject to the conditions laid down under Section 438(2) Cr.P.C. (Rajendra Kumar Mishra, J) P.S./- U T
