JUSTICE SANJAY PRIYA ORAL ORDER 4/ 25-10-2018 Heard learned counsel for the petitioners and learned APP for the State.

Petitioners seek bail in Mahua P.S. Case No.116 of 2018 instituted for the offence under Section(s) 420, 406, 467, 468, 471/34 Indian Penal Code.

Counsel for the petitioners submits that in the written report there is specific allegation against Branch Manager of the financial institution, namely, Sri Tripurari Sharan Upadhayay, who is still absconding.

In the written report, it is alleged that Branch Manager in connivance with the petitioners, who are Credit Officers, and one Manoj Kumar Thakur, who was Loan Officer,

Patna High Court Cr.Misc. No.52790 of 2018 (4) dt.25-10-2018 2/2 has misappropriated total rupees thirteen lacs and odd by disbursing loan in the name of fifty persons in fictitious manner. In the written report, it is mentioned that these petitioners are Credit Officers in the Bank.

Counsel for the petitioners submits that these petitioners were arrested from the Branch Office and the main accused i.e. Branch Manager is still absconding. From the written report itself, it appears that there is specific allegation against Branch Manager Tripurari Sharan Upadhayay and one Manoj Kumar Thakur.

In the facts and circumstances of the case, prayer of the petitioners for grant of bail is allowed. Let the petitioners, above named, be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Vaishali at Hajipur, in connection with Mahua P.S. Case No.116 of 2018, subject to the condition that both the bailors shall be close relative of the petitioners.
