ANJANA PRAKASH ORAL ORDER 3/ 09-03-2016 In the nature of dispute between the parties, notice had been issued to Opposite Party No.2, but despite service of notice none appears on her behalf.

Having considered the merits of the case, it is ordered that if the Petitioner deposits the entire arrear @ `750/- (seven hundred fifty) from 05.01.2015 till date within a period of six weeks from the date of receipt of a copy of this order and surrenders before the Sub-Divisional Judicial Magistrate, Araria, in connection with Complaint Case No.2760 of 2011, he (Md. Nabibul) shall be released on anticipatory bail on furnishing bail bond of `5,000/- (five thousand) with two sureties of the like amount each or any other surety to be fixed by the court below subject to the condition as laid down under Section

Patna High Court Cr.Misc. No.51650 of 2014 (3) dt.09-03-2016 2/2 438(2) Cr. P. C. and (i) That one of the bailors will be a close relative of the Petitioner, who will give an affidavit giving genealogy as to how he is related with the Petitioner. The bailors will undertake to furnish information to the court about any change in the address of the Petitioner.

From henceforth the Petitioner shall pay `1500/- (one thousand five hundred) in stead of `750/- (seven hundred fifty). The application stands disposed off.
