The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 406 and 420 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is a person with clean antecedent, is a retired karamchari and presently is aged about 68 years and the informant alleges that while the petitioner was in service, he issued a forged parvana regarding settlements of Anabad Bihar Sarkar land in the name of Kanti Devi in the year 1973-74 despite knowing that the land was registered in the name of Bhattu Jamadar for which receipts were being issued. Learned counsel for the petitioner submits that based

No.67276 of 2021(2) dt.21-07-2022 2/2 on the said allegations, the petitioner cannot be even departmentally proceeded in terms of Bihar Pension Rules but still the present FIR has been instituted, it is next submitted that petitioner is a retired government servant and the present FIR came to be instituted without holding any proper inquiry. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Khijar Sarai P.S. Case No. 49 of 2021 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
