JUSTICE VINOD KUMAR SINHA ORAL ORDER 06-09-2018 Heard the parties. The petitioner seeks regular bail in connection with Dumariya P.S.Cased No. 03 of 2013, registered for the offence punishable under Sections 304 (B) and 328/34 of the Indian Penal Code.
Allegation against the petitioner, who happens to be the husband of the deceased, is of torturing for non fulfillment of demand of dowry and ultimately the daughter of the informant has been poisoned to death.
Submission of the learned counsel for the petitioner is that no specific allegation has been attributed against the petitioner and she has committed suicide and moreover, the petitioner is in custody since 04.04.2018.
Patna High Court Cr.Misc. No.44963 of 2018 (3) dt.06-09-2018 2/2 Heard learned A.P.P. as well as learned counsel for the informant opposes the prayer for bail stating that there is allegation of demand of dowry and torture and the daughter of the informant was killed by the accused petitioner. Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant bail to the petitioner.
