The petitioner has preferred this application for grant of regular bail in a case registered under section 30(a) of Bihar Prohibition and Excise Act, 2016 and section 120B of the Indian Penal Code.

As per the prosecution case, on a raid being conducted the accused, Parmatma Rai, was arrested while three other accused persons managed to escape. 467.64 litres of liquor was recovered. The arrested accused disclosed the petitioner to be amongst the accused who had escaped.

It is submitted by learned counsel for the petitioner that neither the petitioner was arrested at the spot nor any incriminating article recovered from his possession. The only

Having heard learned counsel for the parities and taking into consideration the fact of the petitioner not having been arrested at the spot and his having remained in custody for nine months, the petitioner, above-named, is directed to be enlarged on bail in connection with Simari P.S. Case No. 87 of 2021 on his furnishing bail-bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II-cumSpecial Judge, Excise, Buxar.
