Petitioners apprehend arrest in connection with Madhubani (Town) P.S. Case No. 272 of 2016 registered under Sections- 304B/34 of the Indian Penal Code.

It is alleged that daughter in law of the informant received a mobile call from Debu Prashant Mahto that her daughter poured kerosene oil on her body and set fire. She is under treatment at DMCH. Informant reached there and found her daughter dead. He stated that petitioners had tortured her earlier as told by her daughter which caused the incident. Learned counsel for the petitioners submits that

Patna High Court Cr.Misc. No.1368 of 2017 (3) dt.13-02-2017 2/2 petitioners have been falsely implicated in this case merely on suspicion. Moreover, husband has not been made accused. Petitioners are father-in-law and mother-in-law of the deceased. The deceased was a short tempered lady and on very trivial issue she set her on fire. This fact has been supported by several witnesses during investigation. Informant has filed a petition stating that she filed the present case due to misunderstanding. Considering the facts and circumstances of the case, the petitioners, above named, in the event of arrest or surrender within a period of four weeks from today, are directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Madhubani in connection with Madhubani (Town) P.S. Case No. 272 of 2016 subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure.
