The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 304(B), 201 of the Indian Penal Code. The accusation is of killing the daughter of the informant by her in-laws family members including the petitioner being her husband for non-fulfillment of dowry demand.

It is submitted by learned counsel for the petitioner that petitioner has falsely been implicated in this case because he happens to be the husband of the deceased. There is general and omnibus allegation

Patna High Court CR. MISC. No.68030 of 2021(4) dt.07-09-2022 2/2 against all the accused persons including the petitioner. In contra, learned A.P.P, appearing on behalf of the State has vehemently opposed the prayer for anticipatory bail of the petitioner and submitted that petitioner being husband of the deceased was ample responsibility to take care of his wife but he had completely failed to take his responsibility and he was involved in the commission of murder of his wife along with other accused persons. The independent witnesses have also supported the prosecution case.

Considering the fact that petitioner is husband of the deceased and within one year of the marriage, the daughter of the informant died, this Court is not inclined to grant privilege of anticipatory bail to the petitioner. The prayer for grant of anticipatory bail to the petitioner stands rejected.
