JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 09-02-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Nardiganj P.S. Case no. 162 of 2016, registered under Section 30(a) of the Excise Act.

The accusation is that in course of checking of vehicle, 8 bottle, each containing 750 ML, 56 bottles, each containing 375 ML, four bottle, each containing 180 ML, India made foreign liquor recovered from the vehicle and driver of the vehicle succeeded to flee away.

Learned counsel for the petitioner submits that, in fact, the vehicle in question belongs to this petitioner and at that time Dharmendra Kumar was driving the vehicle, whose driving licence was found in the vehicle and this petitioner had no knowledge about carrying of seized liquor by the driver. Further submission is that petitioner is accused in six cases, as detailed in para 3 of the petition,

Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Nawada in connection with Nardiganj P.S. Case No. 162 of 2016, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
