The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 47(A) of the Excise Act.

Country made liquor was recovered from possession of the other co-accused in the year 2012.

Submission is that nothing was recovered from possession of the petitioners. Though, final form was submitted again the petitioners, but the court below has taken cognizance. Considering the facts and circumstances, let the petitioners, above named, in the event of their arrest or surrender

Patna High Court Cr.Misc. No.3755 of 2017 (2) dt.17-02-2017 2/2 before the Court below within a period of four weeks from the date of receipt of the order, be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of S.D.J.M., Daudnagar (Aurangabad)/ Successor Court in connection with Goh Police Station Case No78 of 2012, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
