JUSTICE DINESH KUMAR SINGH ORAL ORDER 17-03-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 365,504 and 506/34 of the Indian Penal Code and sections 3(1)(x) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act. It is alleged that the son of the informant namely Karu Rajbanshi was called by co accused Mahendra Giri on 15.10.2012. It is further alleged that the petitioner was associate of said Mahendra Giri.

It is submitted by the learned counsel for the petitioner that considering the fact that no motive was alleged and the accusation was only supported by the informant, co-accused Mahendra Giri has been granted bail vide Cr. Misc. No. 15528 of 2013.

Patna High Court Cr.Misc. No.10977 of 2015 (2) dt.17-03-2015 2/2 Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.

Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned SDJM, Gaya in connection with S.C./S.T. Gaya P.S. Case No. 79 of 2012 subject to the conditions as laid down under Section 438(2) Cr.P.C.
