JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 2 07-01-2015 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner seeks bail in Mehsi P.S. Case No. 45 of 2013 registered for the offences punishable under Sections 414, 412, 420, 467, 468, 471 read with 34 of the Indian Penal Code as well as 25(1-B)(a), 26 and 35 of the Arms Act. The prayer for bail of the petitioner was rejected earlier by this Court on 23rd January, 2014 in Cr. Misc. No. 3065 of 2014 with following observations:- "The Judicial Magistrate-1st Class, East Champaran at Motihari is directed to expedite

Case No. 45 of 2013 and conclude the same as early as possible and preferably within a period of nine months from the date of receipt/production of a copy of this order. In case, the trial is not concluded within the stipulated period, mentioned above, the petitioner would be at liberty to renew his prayer for bail."

It has been contended that till date only charges have been framed and there is no progress in trial. Having regard to observations made in the aforesaid order dated 23rd January, 2014, the petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Motihari, East Champaran in connection with Mehsi P.S. Case No. 45 of 2013.
