JUSTICE ARUN KUMAR ORAL ORDER 18-03-2017 Heard learned counsels for the petitioner and the State. The petitioner apprehends his arrest in connection with Gopalganj P.S. Case No. 363/2016, instituted under Sections 467, 468, 420, 120(B) and 34 of the Indian Penal Code. The allegation, in brief, is that the petitioner purchased a piece of land from the informant, but fraudulently two sale deeds got executed in his favour.
Learned counsel appearing on behalf of the petitioner submits that only allegation is that two sale deeds were executed by the informant, one he admits genuine but with respect to the second sale deed it is alleged that the same was fraudulently executed, but by following the procedure the second registration was also done after paying the consideration money with respect
Patna High Court Cr.Misc. No.6794 of 2017 (3) dt.18-03-2017 2/2 to the second piece of land. Moreover, the informant has also filed a title suit with respect to the execution of second sale deed. Having considered the aforesaid facts and circumstances and primarily the dispute appears of civil nature, so let the petitioner, Biresh Kumar Chaurasiya, in the event of arrest or surrender before the court below within four weeks from today, be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gopalganj, in connection with Gopalganj P.S. Case No. 363/2016; subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure, 1973.
