JUSTICE SANJAY PRIYA ORAL ORDER 6/ 23-07-2018 Heard learned counsel for the petitioner, learned counsel for the informant and learned APP for the State. Petitioner apprehends her arrest in Agamkuan P.S. Case No.431 of 2017 instituted for the offence under Section(s) 323, and 304(B)/34 Indian Penal Code pending in the Court of the Additional Chief Judicial Magistrate, Patna City. In the written report, there is specific allegation against the petitioner that she along with husband of the deceased has given poisonous substance to daughter of the informant to eat on account of non-fulfillment of demand of dowry, who died during course of treatment.

FSL report was received in Cr. Misc.7628 of 2018 while hearing regular bail application of husband of the deceased.

Patna High Court Cr.Misc. No.28812 of 2018 (6) dt.23-07-2018 2/2 Aforesaid record has been placed with this record, wherein, it is mentioned that FSL Report indicates that in the viscera of the deceased highly poisonous substance was found. The deceased has died within one year of her marriage.

In such circumstances, this Court does not find it a fit case for grant of anticipatory bail.

Prayer of the petitioner for grant of anticipatory bail is rejected.
