The petitioner apprehends his arrest in Dumaria P.S. Case No.76 of 2016 registered under Section 272 of the Indian Penal Code and under section 30(a) of the Bihar Prohibition and Excise Act.

Learned counsel for the petitioner submits that nothing has been recovered from possession of the petitioner. The petitioner is not the owner of the vehicle, but the informant alleged that while he was checking the vehicle on road, the petitioner fled away leaving the motorcycle. The bag was tied on the motorcycle of the petitioner. On search, 40 litres of liquor made of mahua was recovered from the bag.

Having considered the facts aforesaid, I am not
