JUSTICE VINOD KUMAR SINHA ORAL ORDER 05-09-2018 Heard the parties. The petitioner seeks regular bail in connection with Kajara P.S.Case No. 50 of 2017 registered under Sections 147, 148, 149, 324, 307, 302/120B of the Indian Penal Code and 27 of the Arms Act.

Allegation against the petitioner is of assault by stabbing the deceased.

Submission of the learned counsel for the petitioner is that there is general and omnibus allegation of assault and no any specific allegation has been attributed against the petitioner and the petitioner is in custody since 06.09.2017. Heard learned A.P.P. as well as learned counsel for the

Patna High Court Cr.Misc. No.44652 of 2018 (3) dt.05-09-2018 2/2 informant opposes the prayer for bail on the ground that there is direct allegation against the petitioner is of stabbing four injuries on the person of the informant and the trial has been at the advance stage and 13 witnesses have been examined. Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant bail to the petitioner.

With the aforesaid observation, this application is dismissed.
