The petitioner apprehends his arrest in Goh P.S. Case no. 25 of 2009, registered for the offences punishable under Section 396 of the Indian Penal Code and 25(1-b)A/26 of Arms Act.

The informant alleged that some persons entered into his house and during course of committing theft they fired causing injury to Ajay Sao and Ajay Sao died.

It has come that one accused Sambhu Yadav was caught who disclosed the name of the petitioner Dinesh Kumar

Patna High Court Cr.Misc. No.14103 of 2015 (2) dt.08-05-2015 2/2 and Rakesh Kumar.

Learned counsel for petitioner submits that the petitioner is Deodutt Kumar. Except the confessional statement of co-accused there is absolutely no evidence against the petitioner. There appears that the co-accused was apprehended at the spot who disclosed the name of the petitioner Dinesh Kumar and one Rakesh Kumar. The petitioner has got criminal antecedent and he is involved in the murder case.

Considering the facts aforesaid, I am not inclined to enlarge the petitioner above named on anticipatory bail. Accordingly, the same is rejected.
