JUSTICE BIRENDRA KUMAR ORAL ORDER 09-03-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 366A/120B/34 of the Indian Penal Code.

Allegation in the F.I.R. is of kidnapping of Amrita Kumari, aged about 17 years. Petitioner and others are under suspicion. The victim girl in her statement under Section 164 Cr.P.C. levelled allegation against the co-accused Gaurav to have forcefully taken her on a vehicle. The petitioner is friend of Gaurav. The entire statement of the victim girl disclosed the matter of love affairs.

Considering the aforesaid facts, let the petitioner,

Patna High Court Cr.Misc. No.3765 of 2017 (2) dt.09-03-2017 2/2 above named, in the event of his arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Mr. Rahul Kishore, learned Judicial Magistrate, 1st Class, Begusarai/Successor Court in connection with Phulwariya Police Station Case No.138 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
