JUSTICE DINESH KUMAR SINGH ORAL ORDER 19-03-2015 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 341, 323, 325 and 307/34 of the Indian Penal Code.

It is alleged that in the background of land dispute, the informant was assaulted by the accused persons and when the brother and brother's wife of the informant came to rescue, then they were also assaulted.

It is submitted by learned counsel for the petitioner that except one injury of Jogendra Yadav, all the injuries of the informant's side have been found to be simple. There is counter version of the occurrence also and petitioners' side also received injury. A statement has been made in para 3 of the petition that the

Patna High Court Cr.Misc. No.11297 of 2015 (2) dt.19-03-2015 2/2 petitioners have no criminal antecedent.

Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Sherghati, Gaya in connection with Dumaria P.S. Case No. 57 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.
