JUSTICE DINESH KUMAR SINGH ORAL ORDER 28-04-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Section 414 of the Indian Penal Code, sections 25(1-B) a, 26 and 35 of the Arms Act and sections 20 and 22 of the NDPS Act.

On information that the miscreants are preparing to commit some offence, raid was laid when three persons who were seen absconding with suspected theft motorcycle. Two miscreants out of three managed to escape but one person was apprehended with the motorcycle from whose possession one country made pistol with two live cartridges were recovered. The apprehended accused Ajit Kumar disclosed the name of the petitioner Dhananjay Kumar

Patna High Court Cr.Misc. No.18630 of 2016 (2) dt.28-04-2016 2/2 alias Pepe and accused Alok Kumar Rai.

It is submitted by the learned counsel for the petitioner that there is no recovery from the possession of the petitioner and only on suspicion the accusation has been levelled. Though the petitioner is accused in two other cases but he is on bail in those cases.

Let the learned court below consider the prayer for regular bail of the petitioner in case the petitioner surrenders within six weeks from today in connection with Hajipur Town P.S. Case No. 118 of 2016 pending in the court of learned C.J.M. Vaishali at Hajipur.

This application is disposed of with the aforesaid observation/direction.
