JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 21-08-2019 The present writ application substantially involves the issue of officiating allowance to the petitioner. Learned counsel for the petitioner submits that the petitioner was initially appointed as Routine clerk in SVP College Bhabhua, Kaimur and he is actually working as Librarian in the College, in question, for 14 years and as such the petitioner is entitled to officiating allowance for discharging the responsibilities of higher post (Librarian). Without going into the merit of the writ application, the same is disposed of with a direction to the University to verify the record as to whether the petitioner has actually

Patna High Court CWJC No.17017 of 2019(2) dt.21-08-2019 2/2 discharged the responsibility of higher post and on verification if it is found that the petitioner has actually discharged the responsibility of higher post under the lawful order of the competent authority, the University shall ensure payment of officiating allowance for the period the petitioner has worked on the higher post.

Necessary decision in this regard may be taken by the respondents within a maximum period of three months from the date of receipt/production of a copy of this order. With the aforesaid, the writ application stands disposed of.
