Petitioner seeks bail in Dehri(Nagar) P.S.Case No.599 of 2018 registered for the offences under Sections 414 of the I.P.C. and Sections 30(a), 34, 37 (b) of Bihar Prohibition and Excise Act, 2016.

Allegation against the petitioner is of recovery of 440 liters liquor from the vehicle of the petitioner. Submission of the learned counsel for the petitioner is that nothing has been recovered from his conscious possession and he is in custody since 1.7.2018 having no criminal antecedent. Heard learned A.P.P. also.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, be

No.46608 of 2018 (4) dt.17-09-2018 2/2 released on bail on furnishing bail bond of Rs.25,000/- with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-II-cum-Special Judge, Excise, Rohtas at Sasaram, in Dehri (Nagar) P.S. Case No.599 of 2018 subject to the conditions that (1) one of the bailors must be a local person having sufficient immovable property within the jurisdiction of the concerned court. (ii) the petitioner will not induce any witness or tamper with the evidence and the petitioner shall co-operate in disposal of the trail and make himself available as and when required by the court, otherwise, his bail bond shall be cancelled.
