The petitioner apprehends his arrest in a case registered for the offence under Section of the Indian Penal Code.

It is submitted on behalf of petitioner that specific accusation of causing fire-arm injury is against co-accused Neeraj Kumar @ Kallu. So far as this petitioner is concerned, he is only alleged to have fired, but it did not hurt anybody. Petitioner also sustained gun shot injury, which is simple in nature (Annexure - 3). There is case and counter case. Two similarly situated co-accused namely Pramod Kumar @ Pappu Kumar and Nityanand Roy @ Vakil have already been granted anticipatory bail by a coordinate Bench of this Court. Petitioner has got clean antecedent.

Patna High Court CR. MISC. No.67140 of 2021(3) dt.17-10-2022 2/2 Learned A.P.P. for the State has opposed the prayer for anticipatory bail.

Considering the aforesaid facts and circumstances, in the event of arrest/surrender within a period of six weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Patna in connection with Pirbahore P.S. Case No. 193 of 2021, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
