Mr. Shantanu Kumar ====================================================== CORAM: HONOURABLE MR. JUSTICE PRAKASH CHANDRA JAISWAL ORAL ORDER 20-11-2019 Heard learned counsel for the petitioner and learned APP for the State.

The petitioner seeks bail in a case registered for the offence punishable under Sections 363, 365, 366(A) and 120(B)/34 of the Indian Penal Code.

Co-accused Dr. Shailesh Kumar and the petitioner opened nursing home in the house of the informant and nephew of Dr. Shailesh Kumar namely Sujit Kumar was compounder. Said Sujit Kumar kidnapped the minor daughter of the informant in the night and when the informant approached the petitioner and her husband to inquire about the matter they slated him.

It is submitted by learned counsel for the petitioner

Patna High Court CR. MISC. No.52987 of 2019(3) dt.20-11-2019 2/2 that the petitioner has no concern with the aforesaid occurrence. He has been falsely implicated in the case. Victim in her statement recorded under Section 164 Cr.P.C has candidly stated that she had left with Sujit Kumar on her own sweet will for roaming. Said Sujit Kumar has not committed any sort of assault against her. She has not named the petitioner in the occurrence. Petitioner happens to be a lady and has been languishing in custody since 21.06.2019.

Learned APP for the State opposed the bail petition. Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri B.N.Tripathi, Judicial Magistrate, Masaurhi in connection with Dhanarua P.S. Case No.236 of 2019.
