The petitioner seeks bail in a case registered under Section 20 and 22 of the N.D.P.S. Act.
7 kgs. of Ganja is said to have been recovered from the possession of the petitioner.
This is the petitioner's third attempt for grant of bail. Earlier vide order dated 03.01.2018 his prayer for bail was rejected with a direction to the learned lower Court to dispose of the case as expeditiously as possible within six months from the date of receipt/production of a copy of this order. In case of nonconclusion of the trial within the stipulated period, the petitioner may renew his prayer for bail. Hence, this application. From perusal of report of learned lower Court submitted
Patna High Court Cr.Misc. No.47014 of 2018 (03) dt.29-08-2018 2 / 2 vide letter dated 16.08.2018 it appears that out of the six witnesses, two witnesses have been examined. Besides this F.S.L. report and other documents are to be exhibited. Considering the facts aforesaid, the learned Trial Court is granted four months more time to conclude the trial by conducting it on day to day basis and the Superintendent of Police, Bhojpur at Ara is directed to ensure presence of the witnesses on each and every date fixed in the case without fail.
With the aforesaid observation and direction, the prayer for bail of the petitioner is once again rejected. (Prakash Chandra Jaiswal, J) Trivedi/- U T
