JUSTICE VINOD KUMAR SINHA ORAL ORDER 28-08-2019 Petitioner seeks bail in connection with Special Case No. 01 of 2018, arising out of Khagaria P.S. Case No. 916 of 2017, for the offences under Sections 8, 20(b) (ii) (c)/25 of N.D.P.S. Act.

Recovery of 41.384 Kg of Ganga from the Tempo and the petitioner was arrested at the spot.

Earlier prayer for bail of the petitioner was rejected by this Court, vide order dated 06.11.2018, passed in Criminal Misc. No. 65227 of 2018 and vide order dated 27.03.2019 passed in Criminal Misc. No. 16744 of 2019.

Submission of learned counsel for the petitioner is that he is in custody for more than 15 months but and up till now only the charge has been framed in this case and no witness has been examined.

Patna High Court CR. MISC. No.52997 of 2019(2) dt.28-08-2019 2/2 Having heard both sides, in view of the quantity of recovery of ganja, I am not inclined to grant privilege of bail to the petitioner. However, the learned trial court is directed to expedite the trial as the charge has been framed in this case and tried to conclude the trial within a period of 09 months, if the trial is not concluded within the time, the petitioner is at liberty to move for renewal of his bail prayer.
