JUSTICE SANJAY PRIYA ORAL ORDER 25-09-2018 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Sanhoula P.S. Case No. 60 of 2018 instituted for the offence under Sections 341, 323, 307, 504 and 506/34 of the Indian Penal Code. Allegation against the petitioner is that he assaulted father of the informant namely, Naresh Yadav with Khanti on his head due to which he sustained head injury.

The injury report has been enclosed as Annexure-3 which shows that he sustained one lacerated wound measuring 2" x 1⁄2" x 1⁄4" on vertex, one bruise measuring 1" x 1⁄2" on left palm and one abrasion measuring 1" x 1⁄2" on right leg. The opinion has been kept reserved. The Doctor has found all the injuries on the person of father of the informant caused by hard and blunt

Learned A.P.P. has submitted that no final injury has been submitted in the case.

Petitioner is said to be in custody since 6.4.2018. Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhagalpur, in connection with Sanhoula P.S. Case No. 60 of 2018, subject to the condition that both the bailors will be the close relatives of the petitioner.
