JUSTICE VIKASH JAIN ORAL JUDGMENT Date: 08-08-2018 The present writ petition has been filed for the following reliefs- (i) For issuance of an appropriate writ, order or direction for quashing letter dated 06.03.2013 (Annexure-8) whereby the candidature of the petitioner for award of Rajiv Gandhi LPG Vitrak (RGGLV) of the Indian Oil Corporation Limited (MD) at Hasanpura, District Siwan under open category

has been rejected on flimsy ground that the petitioner is not having adequate land in his own name or in the name of family unit on date of application as per policy and that too without giving him an opportunity of being heard.

(ii) For issuance of appropriate writ, order or direction commanding the respondents to grant the Rajiv Gandhi LPG Vitrak (RGGLV) of the Indian Oil Corporation Limited (MD) at Hasanpura, District Siwan under open category to the petitioner as per advertisement dated 17.10.2009.

(iii) For issuance of an appropriate writ, order or direction commanding the respondents to issue the letter of intent (LOI) Rajiv Gandhi LPG Vitrak (RGGLV) of the Indian Oil Corporation Limited (MD) at Hasanpura, District Siwan under open category to the petitioner as per advertisement dated 17.10.2009.

(iv) For any other relief and reliefs for which the petitioner is entitled in the opinion of this Hon'ble High Court.

2. None appears on behalf of the petitioner despite repeated calls.

3. Learned counsel for the respondent-Corporation opposes the writ petition, submitting that the petitioner was not found to have satisfied the requisite conditions for grant of dealership of RGGLV. The petitioner failed to fulfill the requisite parameters as enumerated in para 10 of the counter affidavit, such as insufficient dimension of the land etc.

4. Having regard to the stand of the respondents in the counter
