The petitioner is in custody since 02.07.2019 in connection with Asthawan P.S. Case No. 143/2019 registered for the offence punishable under Sections 397 of the Indian Penal Code.

Learned counsel for the petitioner submits that neither is the petitioner named in the FIR nor has there been any recovery from his possession and only on the basis of suspicion and speculation, the petitioner has been taken into custody. It is further submitted that the petitioner has no criminal criminal antecedent.

In view of the aforementioned facts and circumstances, let the petitioner above named be released on
