JUSTICE DINESH KUMAR SINGH ORAL ORDER 19-03-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 324, 307, 379 and 504 of the Indian Penal Code. It is alleged that the son of Tetar Paswan fought with the informant on the point of weighing potato when son of Tetar Paswan abused, assaulted the informant and took away Rs. 3,000/- thereafter Tetar Paswan along with ten other persons came variously armed when Ajay Kumar caused injury with pistol and Ranvijay Paswan assaulted with iron rod.

It is submitted by learned counsel for the petitioner that the petitioner was not named in the FIR, his name subsequently sprang up. Specific accusation is alleged against the son of Tetar Paswan, Ajay Paswan and Ranvijay Paswan. Other similarly

A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent. Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Aurangabad in connection with Uphara P.S. Case No. 28 of 2013, subject to the conditions as laid down under Section 438(2) Cr.P.C.
