The present application has been filed for modification of the order dated 03.10.2016 passed in Criminal Miscellaneous No.32367 of 2016.
The petitioner being the father of the husband of the informant was granted provisional bail for three months vide order dated 03.10.2016 passed in Criminal Miscellaneous No.32367/2016 in a case registered under sections 498A, 376/511, 354, 379, 323 of the Indian Penal Code and 3/4 of the Dowry Prohibition Act, on the ground that the informant has retracted from initial version and filed a petition to that effect before the learned Court below.
The provisional bail of the petitioner was to be confirmed by the learned Court below on verification of the fact that the informant has filed a compromise petition before the
Patna High Court Cr.Misc. No.10347 of 2017 (2) dt.08-03-2017 2/2 learned Court below.
It is submitted by learned counsel for the petitioner that the petitioner could not surrender and furnish the bail bond since he was suffering from acute jaundice and was under prolonged treatment.
Under the circumstances, the provisional bail of the petitioner in connection with Sheosagar P.S. Case No.306/2015, pending before the learned Additional Chief Judicial MagistrateVI, Rohtas at Sasaram, is extended till 10th of April, 2017. The provisional bail of the petitioner will be confirmed by the learned Court below after verification of the fact that the informant is not inclined to prosecute the petitioner and she has filed a compromise petition to that effect before the learned Court below.
Accordingly, the application is disposed of.
