JUSTICE VINOD KUMAR SINHA ORAL ORDER 01-11-2018 The petitioner seeks regular bail in connection with Muffasil P.S. Case No. 301 of 2018, registered for offences punishable under Sections 323, 379, 387, 504, 307 and 34 of the Indian Penal Code and Section 27 of the Arms Act. Allegation against the petitioner is of firing on the informant, however, the said firing did not hit the informant rather it hit the nephew of the informant on his nose. It has been submitted on behalf of the petitioner that there is case and counter case between the parties and the petitioner has himself received injury in the occurrence and though it is alleged that the bullet was recovered from the nose of the injured after surgery, however, the same has not been brought on
Patna High Court Cr.Misc. No.52007 of 2018 (3) dt.01-11-2018 record. Further submission is that he has been in judicial custody since 02.06.2018.
Learned counsel for the State and informant opposed the prayer for bail and submitted that there is direct allegation against the petitioner of firing causing injury to the nephew of the informant on his nose.
Having heard both sides, considering the aforementioned facts and circumstances, I am not inclined to enlarge the petitioner on bail at this stage.
This application is, accordingly, dismissed.
