The petitioner seeks bail in connection with Excise Case No. 938 of 2021 arising out of Arwal P.S. Case No. 377 of 2021 instituted for the offences under Section 30(a) of the Bihar Prohibition and Excise Act.

Learned counsel for the petitioner submits that the petitioner is in custody since 26.10.2021, is a person with clean antecedent and prosecution report has been submitted in the case.

Learned counsel for the petitioner submits that allegation is of recovery of 810 liters of IMFL from a truck as

Learned counsel for the petitioner submits that the petitioner was the driver of the truck and as such he was not aware of the liquor loaded on the truck by the owner and the transporter.

Learned A.P.P. for the State vehemently opposes the prayer for regular bail of the petitioner.

Considering the fact that the petitioner is in custody since 26.10.2021, prosecution report has been submitted in the case and the petitioner is a person with clean antecedent, let the petitioner above named be released on bail on furnishing bail bond of Rs. 2,000/- (Rupees Two Thousand only) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II-cum-Special Judge, Excise, Jehanabad in connection with Excise Case No. 938 of 2021 arising out of Arwal P.S.
