2. The petitioner has prayed for bail in connection with Chapra Muffasil P.S. Case No.223 of 2024 registered for the offence punishable under Sections 25(1-b)a/26 of the of the Arms Act.
3. The case of the prosecution is that while the police force was in patrolling duty, they found that one person started fleeing seeing the police but was being apprehended. He was identified as Praduman Singh and from his possession, one country made loaded pistol was recovered.
4. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. He has been falsely implicated in this
Patna High Court CR. MISC. No.61397 of 2024(4) dt.16-01-2025 2/2 case due to his previous criminal antecedent. He is languishing in judicial custody since 25.04.2024. There is no independent witness of the seizure list. Though, the petitioner is having criminal antecedent of eight cases only three are of similar nature.
5. The application for bail is opposed by learned APP for the State.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Saran at Chapra, in connection with Chapra Muffasil P.S. Case No. 223 of 2024.
