JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 29-04-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections 302, 380 and 120B/34 of the Indian Penal Code. Petitioner happens to be son-in-law of the deceased and it was petitioner as well as his wife, who were looking after the deceased. The informant is step son of the deceased and claims that petitioner and other accused committed the murder of the deceased with an intent to grab her property. The informant has admitted in his farbbeyan that the deceased had already executed will in favour of the petitioner as well as wife. Learned counsel appearing for the petitioner submits that except suspicion, there is nothing against the petitioner but

No.17949 of 2016 (2) dt.29-04-2016 2/2 learned counsel appearing for the informant submits that in course of investigation, some witnesses claimed to have seen the petitioner and others fleeing from the place of occurrence and one co-accused, namely, Dinesh Sah confessed his guilt disclosing involvement of the petitioner and the other accused in the alleged crime. Petitioner is in jail custody since 29.1.2016 and the investigation against him has already been completed. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M., Munger in connection with Dharhara P.S. Case No.08 of 2016.
