The petitioner apprehends his arrest in Simri P.S. Case No.132 of 2019 registered under Sections 406, 420 and 34 of the Indian Penal Code.

The informant alleged that Laddu Nut, Bawla Nut, Rahul Nut took his bull but they did not return. Later on, the informant asked accused persons to return his bull. Tuntun Yadav and Shambhu Nut disclosed that his bull became traceless.

The learned counsel for the petitioner submits that occurrence is said to have taken place on 01.04.2019 but the F.I.R. was lodged on 19.04.2019. The petitioner has no manner of concern with the bull of the informant. Laddu Nut, Shambhu Nut, Rahul Nut and Bawla Nut have already been enlarged on

Patna High Court CR. MISC. No.53180 of 2019(2) dt.26-08-2019 2/2 anticipatory bail by order dated 31.07.2019 passed in Cr. Misc. No.47608 of 2019.

Taking into consideration the facts aforesaid and nature of allegation made against the petitioner and the fact that similarly situated other accused persons have been granted anticipatory bail, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M. IX, Buxar in connection with Simri P.S. Case No.132 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
